Welcome to HAN LUBES

The portals www.hanlubes.ae (“HanLubes”), and the corresponding mobile application (collectively, “Platforms”), are managed and operated by Han Lubes Chemicals Pvt. Ltd. (“Han Lubes”, “we”, “us” or “our”). Any natural or legal person who accesses and/or uses the Platforms in any manner (“you” or “your”) or uses any current or future service or functionality or offer made available on the Platforms (“Service”) will be subject to these terms and conditions for use of the Platforms (“Terms”), as updated from time to time. Your access to Services, other platforms or utilization of Products (defined below), offers or promotions in relation to the Products, as may be provided by us or our affiliates, may be governed by other terms and conditions, policies or guidelines (“Additional Terms”) along with these Terms. If these Terms are inconsistent with such Additional Terms, the Additional Terms will control to the extent of such inconsistency with respect to the applicable Service or utilization of the Product.

These Terms constitute an electronic record within the meaning of the UAE Electronic Transactions and Commerce Law. This electronic record is generated by a computer system and does not require any physical or digital signatures. Please read these Terms carefully before using or accessing the Platforms or availing any Service. By using the Platforms or availing any Service, you signify your agreement to be bound by these Terms.

For the purposes of these Terms, “Products” shall mean the diverse range of fashion, home and beauty products listed on the Platforms from time to time and other products offered for sale to you on both the Platforms; and We and you are hereinafter individually referred to as “Party” and collectively as “Parties”.

These Terms are divided into 2 (two) parts. Please carefully read all the parts to understand the conditions applicable for usage of the Platforms and for the purchase of Products thereof.

PART A – TERMS AND CONDITIONS FOR USAGE OF THE PLATFORMS

GENERAL

  • The terms and conditions for usage of the Platforms (“Terms of Use”) specifically govern your access and use of the Platforms, which provides a forum for you to discover, select, and buy Products listed on the Platforms at the indicated price at any time, from locations serviceable by us.
  • We may modify the Terms of Use from time to time. Please review the Terms each time you access the Platforms. We reserve the right to change content, format, or suspend operation for maintenance or updates.
  • Accessing or using the Platforms indicates your agreement to these Terms of Use, the Privacy Policy, and any other applicable policies or guidelines (“Agreement”).
  • You are authorized to view and access the Platforms solely for identifying Products, purchasing Products, and processing returns/refunds, in accordance with the Return and Refund Policy.
  • By accepting this Agreement, you affirm you are 18 years or older. Users below 18 must use the Platforms under parental supervision. For corporate use, you represent authority to act on behalf of the entity.

REGISTRATION OF YOUR ACCOUNT

  • Registration may or may not be required to purchase Products. It is a one-time, free process.
  • Registration methods:
    • Create an account by providing necessary information for account creation.
    • Register via successful mobile OTP verification. Orders require login via OTP.
  • You are solely responsible for maintaining account confidentiality. You remain liable for all actions under your account.
  • You must immediately inform us of unauthorized use and log out after each session. We are not liable for losses due to your failure to comply.

COMMUNICATION AND UNSUBSCRIPTION

  • By accepting Terms of Use, you consent to receive updates, offers, and campaigns via SMS, call, email, or other electronic means, even if your number is registered under DND/NCPR.
  • You can unsubscribe from marketing communications by following the instructions in such communications.

ACCESS TO IMAGES

  • By accepting the Terms, you consent to allow access to your camera and gallery for enabling Services.
  • Images uploaded must not: belong to another without permission, be defamatory, obscene, infringe copyrights, contain viruses, impersonate others, or violate applicable laws.
  • You grant us a non-exclusive, royalty-free, transferable license to use uploaded images solely in connection with the Services.
  • Uploaded images may be accessed/processed by third parties for Services. We have no liability for such third-party use.
  • Breach of obligations under this section may result in indemnification to Han Lubes per paragraph 12.

DISCLAIMER OF WARRANTIES, INACCURACIES OR ERRORS

  • Information provided on the Platforms is intended to be accurate, but we make no warranties as to its completeness or accuracy.
  • You must determine the suitability of the information yourself. Use of the Platforms or information is at your own risk.
  • Visual representations are provided to assist users. Delivered products may differ in appearance.
  • No guarantee is provided regarding patents, quality, performance, safety, or availability of the Platforms.
  • The Platforms and Services are provided "AS IS" and "WHERE-IS", without warranties. We disclaim liability for damages arising from use of the Platforms.

AVAILABILITY AND ACCESSIBILITY OF THE PLATFORMS

  • Platforms are controlled from India. Use outside India is at your own risk and responsibility.
  • Services offered in one region may differ from others. Orders may be canceled or redirected based on regional availability.
  • References to Products or Services not available in your country do not imply availability.
  • Fraudulent use of accounts will result in legal action. We reserve the right to delete accounts and dishonor orders without liability.

THIRD PARTY INTERACTION AND LINKS

  • Any correspondence, purchase, or promotions with third parties linked through the Platforms are solely between you and the third party. We have no liability.

COPYRIGHTS AND TRADEMARKS

  • Content on the Platforms is protected by copyright and intellectual property laws.
  • You may use content for personal purposes only, not for commercial use.
  • Unauthorized copying, redistribution, or modification is prohibited.
  • Trademarks may not be used in connection with non-Han Lubes products or services.

LICENSE AND USE OF YOUR CONTENT

  • You grant us a royalty-free, perpetual, irrevocable, non-exclusive license to use your submitted content in connection with the Platforms.
  • We may monitor content and report illegal activity to authorities as needed.
  • Unauthorized submissions may violate laws. You are responsible and indemnify us for such claims.
  • We may terminate access to the Platforms at any time if Terms are breached. License terminates automatically upon termination.

USER WARRANTIES AND RESTRICTIONS

  • You represent that your use of the Platforms will comply with all laws and be truthful, accurate, and lawful.
  • Platforms must be used for lawful purposes only.
  • Prohibited activities include deleting/modifying content, reverse engineering, spreading malware, hacking, or antisocial disruptive acts.
  • Hosting or sharing content that violates laws, harms minors, infringes rights, or contains viruses is prohibited.

INDEMNIFICATION AND LIMITATION OF LIABILITY

  • You agree to indemnify and hold harmless Han Lubes, affiliates, and representatives from third-party claims or liabilities arising from your use of the Platforms.
  • Han Lubes Representatives are not liable for direct or indirect damages, content posted by others, or any actions of other users.

ACCESS OUTSIDE THE UAE

Han Lubes makes no representation that the content is appropriate for use outside the UAE. You are responsible for compliance with local laws.

APPLICABLE LAW AND JURISDICTION

These Terms are governed by UAE law. Any disputes will be submitted to courts in Dubai, UAE for resolution.

FORCE MAJEURE, WAIVER, SEVERABILITY, AMENDMENT & MISCELLANEOUS

  • We are not responsible for delays or failures beyond our control.
  • No provision is waived unless in writing.
  • If any provision is unenforceable, the remainder of Terms will remain in effect.
  • Terms may be amended from time to time. Your relationship is governed by the most current version.
  • Compliance with third-party offers and terms is your responsibility.

PART B – TERMS AND CONDITIONS OF SALE ON HAN LUBES PLATFORM

These Terms of Sale constitute an agreement between us and you and govern the terms on which you purchase Products from us on or through the Platforms. By placing an order, you agree to these Terms of Sale in addition to the Terms of Use.

OUR CONTRACT OF SALE

  • Listing of a Product on the Platforms is an invitation to make an offer to purchase. Placing an order is your offer.
  • After placing an order, you will receive an Order Confirmation via email or SMS. This is an acknowledgment, not acceptance of your offer.
  • Contract is concluded only when the Product is shipped and a Shipment Confirmation is sent to you. We may refuse or cancel orders before shipment.
  • Orders dispatched in multiple packages may receive separate Shipment Confirmations, each concluding a separate contract.
  • All communications regarding orders will be sent to your registered email/phone. You are responsible for keeping them updated.
  • Products are purchased for personal use only and not for resale or business. Orders are limited to household quantities.
  • All orders are subject to product availability, acceptance of your offer, and adherence to Terms of Sale.
  • You authorize us to make declarations to governmental authorities that ordered Products are for personal, non-commercial use.

RETURN AND REFUND

Please refer to the Returns Policy and Refund Policy on the Platforms for applicable procedures.

Availability information is listed on the product page. Dispatch estimates are not guaranteed. You will be notified if a product is unavailable.

PRODUCT PRICING

  • All prices are in Indian Rupees and inclusive of applicable taxes.
  • The shopping cart reflects the latest price. Prices may change between adding to cart and order placement. Price at ordering applies.

LICENSES

You are responsible for obtaining any licenses or permissions required to use, purchase, or possess certain Products and complying with applicable terms.

TAXES

You shall bear all fees, costs, and applicable taxes associated with your purchase.

ELIGIBILITY

Only persons 18+ years old and legally competent can place orders. Minors must involve a parent/guardian.

LIMITATION OF LIABILITY

Our liability, if proven in court, is limited to the money charged for the order under which liability arises. We are not liable for business loss, indirect or consequential losses.

AMENDMENTS

We may update policies and Terms of Sale at any time. Updates required by law apply to previous orders. Invalid or unenforceable conditions do not affect remaining terms.

FORCE MAJEURE

We are not responsible for delays or failures caused by events beyond reasonable control.

WAIVER

No provision is waived unless in writing and signed by us. Waiver of a breach does not imply waiver of other breaches.

GOVERNING LAW AND DISPUTE RESOLUTION

Terms of Sale and transactions are governed by Indian law, with exclusive jurisdiction to courts in Mumbai.

MISCELLANEOUS

  • You must comply with third-party terms (e.g., bank offers, brand promotions) linked in the Platforms.
  • These Terms of Sale supersede all previous oral or written terms for purchase of Products.
